It depends on which state you are from.

If one is a parents with sole custody, then the approval of the other is not needed. However, if both parents have parental responsibility, then the written consent is not needed to take the child out of state, but is needed when taken out of the country.

If the parents are divorced I know In NJ you can not take the child
